1. Acceptance of Terms & Ownership

By installing, accessing, or using the CartBoost application ("Service", "App") via the Wix App Market, you ("Merchant", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must uninstall and discontinue use of the Service immediately.

These Terms govern your relationship with CartBoost ("CartBoost", "we", "us"), a product developed, operated, and owned by TweakDesigns (www.tweakdesigns.in). Your use of Wix.com hosting and storefront services remains subject to Wix's own Terms of Use and platform policies.

2. License Grant & Permitted Use

Subject to your adherence to these Terms, CartBoost grants you a non-exclusive, non-transferable, revocable license to install and run the application on authorized Wix websites registered under your active Wix account.

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of our backend or client bundle engines.
• Use the App to promote deceptive, unlawful, or counterfeit merchandise in violation of applicable e-commerce regulations.
• Interfere with, overload, or compromise the technical integrity or security of CartBoost and Wix native integrations.

3. Subscription Plans & Billing Managed 100% by Wix

CartBoost offers a free-forever tier (Basic) and premium tiers (Starter and Scale). All subscription billing, credit card transactions, invoicing, plan upgrades, and renewals are handled natively, exclusively, and securely through the Wix App Market and Wix Billing infrastructure:

• Free Tier: Includes unlimited drafts and 1 live active bundle offer on your storefront at zero cost.
• Paid Tiers: Invoiced in advance on a monthly or yearly cycle depending on your selected billing term. Yearly plans include an automatic 20% discount.
• Cancellation: You may cancel or downgrade your plan at any time directly through your native Wix Dashboard under Apps • Manage Apps • Subscriptions. Access to paid features continues through the end of the paid billing period.

4. Zero Commission Guarantee

We guarantee that CartBoost does not charge variable transaction cuts, revenue take rates, or GMV commission fees on sales generated through our bundle and volume discount widgets. Your subscription tier fee through Wix is the only fee associated with CartBoost.

5. Merchant Responsibilities

As an online merchant utilizing CartBoost on your Wix store, you are solely responsible for:

• Ensuring all discounts, bundle offers, and savings calculations comply with local advertising and consumer protection truth-in-pricing regulations.
• Maintaining adequate inventory levels in your Wix catalog to fulfill orders placed by shoppers through bundle promotions.
• Publishing clear return, refund, and shipping policies accessible to consumers on your storefront.

6. Service Availability & Performance

We strive to maintain 99.99% uptime across our cloud infrastructure. CartBoost widgets are built to load asynchronously without impacting your Wix Core Web Vitals or storefront response times. However, we do not warrant that service will be completely uninterrupted or error-free during scheduled maintenance or third-party Wix API outages.

7. Disclaimer of Warranties & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARTBOOST IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL TWEAKDESIGNS OR CARTBOOST BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS REPUTATION ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY UNDER ANY CLAIM SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU FOR CARTBOOST IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

"Wix", "Wix Studio", "Wix Harmony", and "Wix Stores" are trademarks or registered trademarks of Wix.com Ltd. CartBoost is an independent third-party application developed for the Wix ecosystem and is not officially operated by Wix.com Ltd.
